Peace Now has scored a significant legal victory against settlement expansion. As a result of its petition, Israel’s High Court has ordered the police to investigate illegal settlement activity in the West Bank – the first time the court has issued such an order. The decision comes after six years of hearings and repeated postponement requests from the state, which sought to avoid investigating the funding, initiation and construction of illegal outposts and neighbourhoods in the West Bank.

Outposts are settlements erected without official approvals and permits and are considered illegal, even under Israeli law. However, as the case demonstrates, successive Israeli governments have turned a blind eye to the phenomenon since it arose in the 1990s.

In 2018, Peace Now filed a petition for a criminal investigation of the Hayovel outpost, deep in the West Bank. The petition was one of six that Peace Now filed against similar outposts. In 2021, state officials did not dispute that the Hayovel construction was illegal. They committed to establishing an enforcement unit within the Civil Administration, the civilian body that governs the West Bank. However, the state delayed the establishment of this unit and outright cancelled the plan after far-right, settler-sympathizing Bezalel Smotrich took control of most of the Civil Administration. This development, and Peace Now’s persistence in the case, led to the current court order that the police must step in.  The court made it clear the government must not continue to flaunt its own rules.

Attorney Michael Sfard, who represented Peace Now in the case, along with attorney Alon Sapir stated: “The illegal construction in outposts and settlements is an organized crime on a huge scale. It’s time for the law enforcement authorities to do their job. The Peace Now success was a positive event in a week of otherwise very troubling developments. Ceasefire talks again stalled, dashing hopes for an imminent release of hostages and alleviation of civilian suffering in Gaza. Prime Minister Netanyahu doubled down on his intention to do full-scale battle against Hamas in densely populated Rafah, defying Israel’s greatest ally, the United States. With President Biden’s promise to pause certain arms shipments to Israel, the country became further isolated. Meanwhile, the clashes between Hezbollah and the IDF on Israel’s northern border intensified.

There has been much astute analysis on how Netanyahu’s conduct of the Gaza war has been a mounting disaster.  The criticisms include: no exit strategy, no “day after” plan, sinking deeper into quagmire, abandoning the hostages, creating a humanitarian catastrophe, and failing to recognize that military force alone will not neutralize Hamas.
